اتفاقنا معك… بالواضح

هذه الشروط تنظم استخدامك لموقع حاكي وخدماته، بما فيها المكالمة التجريبية. باستخدامك للموقع أو الخدمة فأنت توافق عليها، وإذا كنت تتصرف نيابة عن منشأة فأنت تقر بصلاحيتك لإلزامها بها.
٠١وصف الخدمة
حاكي منصة وكلاء اتصال بالذكاء الاصطناعي ترد على مكالمات المنشآت وتنفذ إجراءات يحددها العميل — مثل حجز المواعيد وإرسال رسائل واتساب والتكامل مع أنظمته. تُقدم الخدمة وفق الباقة أو الاتفاقية المبرمة مع كل عميل، وقد تتطور مزاياها من وقت لآخر. حاكي مزود تقنية وليس مشغل اتصالات: يبقى العميل هو المشترك لدى مقدمي خدمات الاتصالات المرخصين ومالك أرقامه، ومسؤولًا عن أي تسجيل أو تصريح يتطلبه نشاطه لدى الجهات المختصة.
٠٢المكالمة التجريبية والاستخدام المقبول
المكالمة التجريبية مخصصة للمنشآت والأفراد المهتمين فعليًا بتقييم الخدمة. يُحظر:
- تقديم أرقام لا تملكها أو لا تملك إذن أصحابها.
- تكرار الطلبات بشكل آلي أو مفرط، أو محاولة التحايل على ضوابط النموذج.
- استخدام التجربة للمضايقة أو المقالب أو أي غرض غير مشروع.
نحتفظ بالحق في رفض أو إيقاف أي طلب تجريبي دون إبداء أسباب، وفي تقييد عدد الطلبات من نفس الجهة.
٠٣الحسابات والأهلية
يشترط أن تكون بعمر ١٨ عامًا فأكثر، وأن تقدم معلومات صحيحة ومحدثة. أنت مسؤول عن سرية بيانات الدخول لحسابك وعن كل نشاط يتم من خلاله، وتلتزم بإشعارنا فورًا عند أي استخدام غير مصرح به.
٠٤الرسوم والدفع
تُحدد الرسوم وفق الباقة أو الاتفاقية المبرمة. يجوز تعديل الأسعار بإشعار مسبق لا يقل عن ٣٠ يومًا، ولا يسري التعديل على فترة اشتراك مدفوعة مسبقًا. التأخر في السداد قد يؤدي إلى تعليق الخدمة بعد إشعار.
٠٥بيانات العملاء وتسجيل المكالمات
فيما يخص بيانات عملاء منشأتك التي يعالجها حاكي نيابة عنك، فأنت «جهة التحكم» ونحن «جهة المعالجة». تقر وتتعهد بأن لديك الأساس النظامي اللازم لتسجيل المكالمات ومعالجة بيانات المتصلين، بما في ذلك إشعارهم وفق الأنظمة المعمول بها. تُعالج هذه البيانات وفق سياسة الخصوصية واتفاقية معالجة البيانات (DPA) المبرمة معك.
٠٦الملكية الفكرية
المنصة والنماذج والأصوات والتصاميم والعلامة التجارية وكل ما يتصل بها ملك لحاكي أو لمرخصيها. بياناتك ومحتواك يبقيان ملكك، وتمنحنا ترخيصًا محدودًا غير حصري لمعالجتها للقدر اللازم لتقديم الخدمة فقط. لا يجوز نسخ المنصة أو هندستها عكسيًا أو إعادة بيعها دون اتفاقية مكتوبة.
٠٧الاستخدام المحظور
- أي نشاط مخالف لأنظمة المملكة أو حقوق الغير.
- الانتحال أو الاحتيال أو التضليل في هوية المتصل أو المنشأة.
- استخدام الخدمة لإرسال محتوى ضار أو مزعج أو غير مرغوب فيه.
- محاولة اختراق المنصة أو فحص ثغراتها أو تعطيلها.
٠٨إخلاء المسؤولية
تُقدم الخدمة «كما هي» و«حسب توفرها». تقنيات الذكاء الاصطناعي قد تخطئ في الفهم أو الرد، والعميل مسؤول عن مراجعة الإجراءات الحساسة وتهيئة حدود مناسبة لصلاحيات حاكي. لا نضمن عمل الخدمة دون انقطاع أو خلوها من الأخطاء، ولا نضمن نتائج تجارية محددة.
٠٩حدود المسؤولية
إلى الحد الذي تجيزه الأنظمة، لا نتحمل المسؤولية عن الأضرار غير المباشرة أو التبعية أو خسارة الأرباح أو الفرص. ويكون الحد الأقصى لمجمل مسؤوليتنا تجاهك عن أي مطالبة هو إجمالي الرسوم المدفوعة منك خلال الاثني عشر شهرًا السابقة لنشوء المطالبة. لا يقيد هذا البند أي مسؤولية لا يجيز النظام تقييدها.
١٠الإيقاف والإنهاء
يحق لنا تعليق الخدمة أو إنهاؤها عند مخالفة هذه الشروط أو إساءة الاستخدام، مع إشعارك ما لم تكن المخالفة جسيمة. عند انتهاء الخدمة تُعاد بياناتك أو تُتلف وفق سياسة الخصوصية واتفاقية معالجة البيانات.
١١تعديل الشروط
قد نحدّث هذه الشروط من وقت لآخر، وننشر النسخة المحدثة في هذه الصفحة مع تاريخها. التعديلات الجوهرية تكون بإشعار مسبق، واستمرارك في استخدام الخدمة بعد نفاذها يعد موافقة عليها.
١٢القانون الواجب التطبيق
تخضع هذه الشروط لأنظمة المملكة العربية السعودية، ويختص بنظر أي نزاع الجهات القضائية المختصة في المملكة. عند الاختلاف بين النسختين العربية والإنجليزية، يُعتد بالنص العربي.

These terms govern your use of the Haki website and services, including the demo call. By using the site or service you agree to them, and if you act on behalf of a business you confirm you are authorized to bind it.
01The service
Haki is an AI call-agent platform that answers business calls and performs actions the customer configures — such as booking appointments, sending WhatsApp messages, and integrating with their systems. The service is provided per the package or agreement concluded with each customer, and its features may evolve over time. Haki is a technology provider, not a telecommunications operator: the customer remains the subscriber with licensed telecom providers and the owner of its numbers, and is responsible for any registration or permit its activity requires with the competent authorities.
02The demo call & acceptable use
The demo call is intended for businesses and individuals genuinely evaluating the service. The following is prohibited:
- Submitting numbers you do not own or lack the owner's permission to use.
- Automated or excessive repeated requests, or attempts to circumvent the model's safeguards.
- Using the demo for harassment, pranks, or any unlawful purpose.
We reserve the right to refuse or stop any demo request without stating reasons, and to limit requests from the same party.
03Accounts & eligibility
You must be 18 or older and provide accurate, up-to-date information. You are responsible for the confidentiality of your account credentials and all activity under your account, and you agree to notify us immediately of any unauthorized use.
04Fees & payment
Fees are set by the package or agreement in place. Prices may change with at least 30 days' prior notice, and changes do not apply to an already-paid subscription period. Late payment may lead to suspension of service after notice.
05Customer data & call recording
For your business's customer data processed by Haki on your behalf, you are the data controller and we are the processor. You represent that you have the legal basis required to record calls and process callers' data, including notifying them as applicable law requires. Such data is processed per our Privacy Policy and the Data Processing Agreement (DPA) concluded with you.
06Intellectual property
The platform, models, voices, designs, trademark, and everything related to them belong to Haki or its licensors. Your data and content remain yours, and you grant us a limited, non-exclusive license to process them only to the extent needed to provide the service. Copying, reverse engineering, or reselling the platform without a written agreement is prohibited.
07Prohibited use
- Any activity violating the laws of the Kingdom or the rights of others.
- Impersonation, fraud, or misrepresenting caller or business identity.
- Using the service to send harmful, abusive, or unsolicited content.
- Attempting to breach, probe, or disrupt the platform.
08Disclaimers
The service is provided "as is" and "as available." AI technologies can misunderstand or err; the customer is responsible for reviewing sensitive actions and configuring appropriate limits on Haki's authority. We do not warrant uninterrupted or error-free operation, nor any specific business outcomes.
09Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential damages or loss of profits or opportunities. Our aggregate liability for any claim is capped at the total fees you paid in the twelve months preceding the claim. Nothing here limits liability that cannot lawfully be limited.
10Suspension & termination
We may suspend or terminate the service for breach of these terms or abuse, with notice unless the breach is serious. Upon termination, your data is returned or destroyed per the Privacy Policy and the DPA.
11Changes to these terms
We may update these terms from time to time and will post the updated version on this page with its date. Material changes will come with prior notice, and continued use after they take effect constitutes acceptance.
12Governing law
These terms are governed by the laws of the Kingdom of Saudi Arabia, and the competent judicial authorities in the Kingdom have jurisdiction over any dispute. In case of conflict between the Arabic and English versions, the Arabic text prevails.
